These Terms of Service (“Terms”) govern your access to and use of www.tropein.com and any other website, account, application, content, functionality, or online service operated by Tropein LLC that links to these Terms (collectively, the “Site”), as well as purchases made directly from Tropein LLC through the Site.
The Site is operated by Tropein LLC, a Wyoming limited liability company (“Tropein,” “we,” “us,” or “our”).
Please read these Terms carefully. Section 20 contains a binding arbitration agreement and class-action and jury-trial waivers that affect your legal rights. Unless you timely opt out, most disputes between you and Tropein must be resolved through individual arbitration rather than in court.
By accessing or using the Site, creating an account, submitting an order, enrolling in a subscription, or otherwise indicating your acceptance of these Terms, you agree to be bound by these Terms and the policies incorporated into them. If you do not agree, do not use the Site or purchase products through it.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site or purchase Tropein products.
By accessing the Site or placing an order, you represent that you are at least 18 years old and that the information you provide is accurate and complete.
If you access the Site or place an order on behalf of a company or another legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” includes both you and the entity.
2. Products
Tropein may offer products including mushroom-based nootropic oral pouches, storage containers, hats, apparel, accessories, conventional food products, and other merchandise.
Tropein’s mushroom-based oral pouches are marketed as dietary supplements. Certain products that Tropein may offer in the future, including mushroom-containing chocolate bars, may be marketed as conventional foods rather than dietary supplements.
Products, flavors, ingredients, packaging, quantities, prices, and availability may change without notice. We may discontinue a product or limit the quantity available for purchase at any time.
We make reasonable efforts to display product photographs, colors, dimensions, packaging, and descriptions accurately. Actual colors and appearance may vary depending on your device, production batch, packaging updates, or other factors.
Product packaging and labels may contain information that is more current than information displayed on the Site. You should always read and follow the product label, ingredient list, allergen information, warnings, and directions before use.
3. Product Use, Health, and Safety
Tropein products are intended only for lawful use by adults who are at least 18 years old.
You agree to:
- Use products only as directed on their labels;
- Not exceed the recommended amount;
- Review all ingredients and allergen information before use;
- Keep products away from children and animals;
- Store products according to their labeling; and
- Stop using a product if you experience an adverse reaction.
Consult a qualified healthcare professional before using a dietary supplement if you are pregnant, nursing, taking medication, have allergies, have a medical condition, are planning a medical procedure, or have questions about whether a product is appropriate for you.
If you believe you are experiencing a medical emergency, stop using the product and contact emergency services immediately. Product complaints and adverse reactions may also be reported to Support@Tropein.com.
Information provided through the Site is for general informational purposes and is not medical advice. Nothing on the Site is intended to replace advice, diagnosis, or treatment from a physician or other qualified healthcare professional.
For dietary-supplement products and associated statements, where applicable: statements concerning dietary supplements have not been evaluated by the United States Food and Drug Administration. Dietary-supplement products are not intended to diagnose, treat, cure, or prevent any disease.
Individual experiences and results vary. Tropein does not promise or guarantee any particular health, wellness, cognitive, performance, or other result.
4. Orders and Acceptance
Your order is an offer to purchase the products identified in the order. We may accept or reject an order in our discretion, including because of:
- Product unavailability;
- Suspected fraud or unauthorized payment;
- Incorrect pricing or product information;
- Shipping restrictions;
- Unusually large quantities;
- Suspected resale or commercial distribution;
- Violation of these Terms; or
- Other lawful business or security reasons.
An automated order confirmation only confirms that we received your order. It does not constitute final acceptance. An order is accepted when we process it for fulfillment or send confirmation that it has shipped.
If we cancel an order after payment has been authorized or collected, we will void the authorization or refund the canceled amount, as applicable.
Products purchased through the Site are intended for personal use unless Tropein has separately approved the purchaser as a wholesaler or authorized reseller. You may not resell Tropein products or represent yourself as an authorized Tropein distributor without our written permission.
5. Pricing, Payment, and Taxes
Prices are displayed in United States dollars unless otherwise stated. Applicable taxes, shipping charges, and other charges will be disclosed during checkout.
You authorize Tropein and its payment providers to charge the payment method submitted with your order for the total amount shown at checkout.
You represent that:
- You are authorized to use the payment method;
- The billing information you provide is accurate;
- You will update expired or inaccurate payment information; and
- Charges incurred through your account are authorized by you.
We may correct typographical, pricing, promotional, or product-description errors. If an error affects an order you submitted, we may contact you for instructions or cancel and refund the affected order.
6. Promotions and Discounts
Tropein may offer promotional codes, introductory pricing, bundles, gifts, discounts, or other offers.
Unless otherwise stated:
- Promotions are available for a limited time;
- Promotions have no cash value;
- Promotional codes may not be combined;
- Promotions may be limited by customer, household, account, product, or order;
- Promotions may not apply to subscriptions or prior purchases;
- Promotions are void where prohibited; and
- We may modify or end a promotion as permitted by law.
Additional terms presented with a promotion form part of these Terms.
7. Shipping and Delivery
Tropein currently ships within the United States, subject to product availability and applicable restrictions.
Orders are ordinarily processed within one business day. Standard shipping is estimated to take approximately three to five business days after processing. Processing and delivery dates are estimates and are not guaranteed.
Delays may result from carrier operations, weather, holidays, supply interruptions, address problems, high order volume, or events outside Tropein’s reasonable control.
Shipping charges and available shipping methods will be displayed during checkout.
You are responsible for providing a complete and accurate shipping address. If an order is returned, delayed, lost, or delivered incorrectly because you supplied an inaccurate or incomplete address, you may be responsible for additional shipping costs. Tropein is not required to refund or replace an order that cannot be recovered because of an address error, except where required by law.
Title and risk of loss transfer to you upon delivery, except where applicable law requires otherwise.
If tracking identifies a package as delivered but you cannot locate it, contact Support@Tropein.com promptly. You should also check the delivery location, household members, neighbors, building management, and the carrier. Tropein may assist with a carrier investigation but does not guarantee replacement of packages confirmed as delivered.
If we cannot ship within the represented period, we will provide any notice, opportunity to consent to a delay, cancellation option, or refund required by applicable law.
8. Damaged, Defective, or Incorrect Products
You must inspect your order after delivery.
To report a product that arrived damaged, defective, or different from what you ordered, contact Support@Tropein.com within seven days after delivery. Your report must include:
- Your order number;
- A description of the issue;
- Photographs clearly showing the product, packaging, and damage or error; and
- Any additional information reasonably requested to evaluate the claim.
For an approved claim, Tropein will ordinarily replace the affected product. If replacement is unavailable or otherwise required by law, Tropein may provide another legally appropriate remedy.
Do not discard the affected product or packaging until we have completed our review.
9. Returns and Refunds
9.1 Oral pouches
Unopened oral-pouch products may be returned within 30 days after delivery only if they are:
- Completely sealed;
- Unused;
- Unopened;
- Undamaged; and
- In brand-new, resalable condition with the original packaging intact.
Opened, used, partially consumed, unsealed, damaged, or altered pouch products cannot be returned.
9.2 Hats and storage containers
Unused hats and metal storage containers may be returned within 30 days after delivery if they remain in brand-new condition with their original packaging, tags, and accessories.
Worn, washed, used, damaged, altered, or incomplete merchandise cannot be returned.
9.3 Food products
Chocolate bars and other food products are final sale and cannot be returned, except when delivered damaged, defective, or incorrect or when a return or refund is required by law.
9.4 Return procedure and costs
Before returning an eligible product, contact Support@Tropein.com for return instructions. Unauthorized returns may be refused.
Customers are responsible for return shipping costs. Original shipping charges are nonrefundable. We recommend using a trackable shipping method because Tropein is not responsible for returned products lost before reaching us.
Approved refunds will be issued to the original payment method after the returned products are received and inspected. Financial institutions may require additional time to post a refund.
Products that do not satisfy this return policy may be refused or returned to the customer at the customer’s expense.
Nothing in this section limits return, replacement, refund, or cancellation rights that cannot legally be waived.
10. Subscriptions and Automatic Renewal
Tropein may offer automatically renewing subscriptions for eligible oral-pouch products.
10.1 Subscription frequencies and discounts
Available delivery frequencies may include every one, two, three, four, or eight weeks.
Subscription savings may include discounts of 5%, 10%, or 15%, depending on the offer, product, quantity, or delivery frequency selected. The applicable price, discount, delivery frequency, and recurring charge will be displayed before enrollment.
10.2 Automatic renewal authorization
By enrolling in a subscription, you expressly authorize Tropein and its payment providers to charge your selected payment method automatically at the frequency and price disclosed during enrollment, plus applicable taxes and shipping charges, until you cancel.
Your subscription continues and renews automatically unless canceled.
There is no minimum number of subscription shipments unless a particular offer clearly discloses a minimum commitment before enrollment.
10.3 Subscription acknowledgment
After enrollment, Tropein will provide an acknowledgment containing or linking to the material subscription terms, including the recurring price, frequency, and cancellation method.
You are responsible for maintaining an accurate email address and payment method.
10.4 Managing and canceling subscriptions
You may cancel your subscription at any time through the online account or subscription-management portal or by emailing Support@Tropein.com.
You may also use the available account tools to pause, skip, reschedule, or modify future shipments, including available flavor or quantity changes.
Cancellation will take effect promptly. If a recurring charge has already been processed before the cancellation request is received, the cancellation ordinarily applies to the following renewal, and the processed order remains subject to the return policy in Section 9.
Tropein will not require you to speak with a representative, listen to a sales presentation, or complete unnecessary steps to cancel.
10.5 Price changes
Tropein may change subscription prices or discounts by providing at least 30 days’ advance notice to the email address associated with your subscription.
If you do not agree to a change, you must cancel before the change takes effect. Continued subscription after the effective date constitutes authorization for the disclosed updated recurring charge, to the extent permitted by law.
10.6 Failed payments
If a recurring payment cannot be processed, Tropein or its subscription provider may retry the payment, ask you to update your payment method, delay the shipment, or cancel the subscription.
We may cancel a subscription because of unavailable products, suspected fraud, repeated payment failure, misuse, or another lawful business reason. If we cancel, we will not charge you for unshipped future renewals.
11. Accounts and Account Security
You may create an account or use guest checkout.
If you create an account, you agree to provide accurate information, keep it updated, protect your login credentials, and notify Support@Tropein.com promptly if you suspect unauthorized access.
You are responsible for activity conducted through your account to the extent permitted by law. You may not sell, transfer, or share an account in a manner that compromises its security.
We may suspend or terminate accounts involved in fraud, abuse, security incidents, prohibited conduct, or violations of these Terms.
12. Reviews and Customer Content
The Site may allow you to submit ratings, reviews, comments, photographs, videos, testimonials, social-media content, questions, or other materials (“Customer Content”).
You retain ownership of your Customer Content. By submitting it to Tropein, you grant Tropein a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to host, reproduce, display, publish, format, adapt, distribute, and use the Customer Content in connection with Tropein’s products, Site, social-media accounts, advertising, and marketing.
This license continues for as long as reasonably necessary for those purposes, subject to applicable law and our Privacy Policy.
You represent that:
- You created or control the Customer Content;
- You have permission from every identifiable person appearing in it;
- It is truthful and reflects your honest experience;
- It does not infringe intellectual-property, privacy, publicity, or other rights;
- It does not contain confidential information, malware, unlawful material, or deceptive claims; and
- Any material connection with Tropein has been appropriately disclosed.
Tropein may moderate or remove Customer Content when permitted by law, but we are not obligated to publish every submission.
Nothing in these Terms prohibits or restricts an honest review, legally protected report, consumer complaint, government communication, or other activity protected by applicable law.
Testimonials describe individual experiences and do not guarantee that another customer will experience similar results.
13. Acceptable Use
You may use the Site only for lawful, personal, and noncommercial purposes unless Tropein provides written authorization otherwise.
You may not:
- Violate any law or third-party right;
- Use another person’s account without permission;
- Impersonate another person or entity;
- Submit false, misleading, or fraudulent information;
- Interfere with the operation or security of the Site;
- Introduce malware or harmful code;
- Attempt to bypass access controls;
- Scrape, crawl, harvest, or extract Site data through unauthorized automated means;
- Collect personal information about other users;
- Send spam or unauthorized solicitations;
- Copy, reproduce, distribute, sell, or commercially exploit Site content without permission;
- Reverse engineer Site functionality except where the restriction is prohibited by law;
- Use Site content to train or develop an artificial-intelligence or machine-learning system without written permission;
- Place orders for unauthorized resale or export; or
- Encourage another person to engage in prohibited conduct.
We may investigate suspected violations and cooperate with lawful investigations or requests.
14. Intellectual Property
The Site and its content—including trademarks, logos, product names, packaging, text, graphics, photographs, videos, software, designs, and arrangement—are owned by Tropein or its licensors and are protected by intellectual-property laws.
Subject to these Terms, Tropein grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal, noncommercial use.
No ownership right is transferred to you. All rights not expressly granted are reserved.
“TROPEIN,” associated logos, trade dress, and product names may not be used without Tropein’s prior written permission.
If you voluntarily send ideas, suggestions, or feedback, you grant Tropein a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.
15. Third-Party Services and Links
The Site may be hosted by Shopify and may rely on third parties for payment processing, subscriptions, shipping, reviews, analytics, communications, advertising, customer support, or other functionality.
Your use of third-party services may be governed by additional terms and privacy policies from those providers.
The Site may contain links to third-party websites. Tropein does not control or endorse third-party websites and is not responsible for their content, availability, security, products, or practices.
16. Marketplace Purchases
Tropein products may eventually be sold through Amazon, TikTok Shop, Walmart, or other third-party marketplaces.
Purchases made through a third-party marketplace are also governed by that marketplace’s applicable terms, payment rules, shipping practices, and return policies. If marketplace terms conflict with these Terms regarding a marketplace transaction, the marketplace terms control that transaction to the extent of the conflict.
Product-use, safety, intellectual-property, and other provisions that are not specific to checkout may continue to apply where appropriate.
17. Privacy
Tropein’s collection and use of personal information are described in its Privacy Policy, which is incorporated into these Terms by reference.
The Privacy Policy should be reviewed before you use the Site, create an account, submit Customer Content, or place an order.
18. Email and Text Communications
You may receive transactional communications concerning orders, accounts, subscriptions, deliveries, safety matters, or customer-service requests.
If you separately opt in to promotional email or text messages, Tropein may send marketing communications in accordance with the consent presented at enrollment.
Consent to promotional text messages is not a condition of purchase. Message frequency may vary. Message and data rates may apply. You may opt out of promotional text messages by replying STOP and request assistance by replying HELP or contacting Support@Tropein.com.
You may unsubscribe from promotional emails using the unsubscribe link in an email. Transactional or legally required communications may continue after a marketing opt-out.
19. Disclaimers and Limitation of Liability
19.1 Site and product disclaimers
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” Tropein does not warrant that the Site will always be uninterrupted, error-free, secure, or free from harmful components.
Except for express promises contained in an applicable written policy or product label, and subject to rights that cannot be waived, Tropein disclaims implied warranties including merchantability, fitness for a particular purpose, title, and noninfringement.
Some jurisdictions do not allow particular warranty exclusions, so some exclusions may not apply to you.
19.2 Limitation of liability
To the fullest extent permitted by law, Tropein and its members, managers, officers, employees, affiliates, agents, contractors, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or relating to the Site, these Terms, or a product.
To the fullest extent permitted by law, Tropein’s aggregate liability arising from or relating to the Site, these Terms, or products purchased through the Site will not exceed the greater of:
- $100; or
- The amount you paid directly to Tropein during the 12 months preceding the event giving rise to the claim.
These limitations do not exclude liability that cannot legally be limited, including liability to the extent caused by fraud, willful misconduct, gross negligence, or another matter for which limitation is prohibited by law.
20. Dispute Resolution and Binding Arbitration
20.1 Informal resolution
Before filing arbitration or a lawsuit, the complaining party must send the other party a written Notice of Dispute describing:
- The party’s name and contact information;
- The order or account involved;
- The nature and factual basis of the dispute; and
- The relief requested.

The parties will attempt in good faith to resolve the dispute for 30 days after receipt of a complete Notice of Dispute. Applicable limitation periods will be tolled during this 30-day period to the extent permitted by law.
20.2 Agreement to arbitrate
Except for disputes excluded below, you and Tropein agree that every dispute or claim arising out of or relating to these Terms, the Site, an order, a subscription, a communication, or a Tropein product will be resolved through final and binding individual arbitration.
This arbitration agreement is governed by the Federal Arbitration Act.
20.3 Arbitration administrator and rules
Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and Mediation Procedures in effect when the arbitration is filed, as modified by these Terms.
The AAA rules are available at www.adr.org.
A single neutral arbitrator will decide the dispute. The arbitrator may award the same individual remedies that a court could award under applicable law.
If AAA is unavailable or declines to administer the dispute, the parties will attempt to select another nationally recognized consumer-arbitration administrator. If they cannot agree, a court with jurisdiction may appoint an administrator or arbitrator.
20.4 Location and format
Arbitration may occur through documents, telephone, video conference, or an in-person hearing, as allowed by the AAA rules.
A customer will not be required to travel to Wyoming. Any in-person consumer hearing will take place in the county where the customer resides or another mutually agreed location, unless applicable rules or law require otherwise.
20.5 Fees
Payment and allocation of filing, administrative, and arbitrator fees will be governed by the AAA Consumer Rules and applicable law.
Tropein will pay amounts the business is required to pay under those rules. Tropein will not seek reimbursement of its arbitration fees from a consumer unless the arbitrator determines that the consumer’s claim was filed for harassment or was patently frivolous, and applicable law permits reimbursement.
Each party ordinarily bears its own attorneys’ fees unless an applicable law or valid claim authorizes a fee award.
20.6 Excluded disputes
Either party may bring an eligible individual claim in small-claims court.
Either party may seek temporary or preliminary injunctive relief in court when necessary to protect intellectual-property rights, confidential information, account security, or prevent unauthorized access, pending a final arbitration decision.
Claims for public injunctive relief or other remedies that applicable law does not permit to be arbitrated or waived may proceed in court, while arbitrable claims will remain in arbitration.
20.7 No class proceedings
You and Tropein agree that disputes will be resolved only on an individual basis.
Neither party may bring or participate in a class, collective, consolidated, coordinated, mass, private-attorney-general, or representative action in arbitration, except to the extent a particular representative claim cannot legally be waived.
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim.
20.8 Jury-trial waiver
For any dispute that proceeds in court rather than arbitration, you and Tropein knowingly and voluntarily waive the right to a jury trial to the fullest extent permitted by law.
20.9 Arbitration opt-out
You may opt out of this arbitration agreement by emailing Support@Tropein.com within 30 days after you first accept these Terms.
Your opt-out notice must include your full name, email address, mailing address, and a clear statement that you wish to opt out of the arbitration agreement in the Tropein Terms of Service.
Opting out of arbitration does not opt you out of the remaining Terms and will not affect your ability to use the Site or purchase products.
20.10 Severability of arbitration terms
If a portion of this arbitration agreement is found unenforceable, it will be severed and the remainder enforced to the fullest extent permitted by law.
However, if the prohibition on class arbitration is found unenforceable as to a particular claim, that claim will proceed in court rather than class arbitration.
21. Governing Law and Court Venue
These Terms are governed by the Federal Arbitration Act and, where state law applies, the laws of the State of Wyoming, without regard to conflict-of-law principles.
This choice does not deprive a consumer of non-waivable protections provided by applicable law.
Subject to Section 20, any court proceeding must be brought in a state or federal court located in Laramie County, Wyoming, except for eligible small-claims proceedings or where applicable law requires another venue.
22. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Tropein and its affiliates, members, managers, officers, employees, agents, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your unlawful or unauthorized use of the Site;
- Your material violation of these Terms;
- Your Customer Content;
- Your infringement of another person’s rights; or
- Your resale, alteration, misuse, or unlawful distribution of a Tropein product.
This section does not require a consumer to indemnify Tropein for Tropein’s own negligence, unlawful conduct, or another matter for which indemnification is prohibited.
23. Suspension and Termination
You may stop using the Site at any time. Subscription cancellation is governed by Section 10.
Tropein may suspend or terminate access to an account or the Site if we reasonably believe you violated these Terms, engaged in fraud or abuse, created a security risk, or acted unlawfully.
Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limitations, dispute resolution, indemnification, and miscellaneous provisions—will survive.
24. Changes to the Site or Terms
Tropein may modify, suspend, or discontinue products, features, or portions of the Site.
We may update these Terms from time to time. The updated Terms will identify the revision date.
If a change is material, we will provide reasonable notice, such as through the Site, account, or email. Changes will apply prospectively from their stated effective date unless applicable law permits otherwise.
Changes to Section 20 will not apply to a dispute for which Tropein received a complete Notice of Dispute before the change became effective.
If you do not agree to updated Terms, you must stop using the Site and cancel any subscription before the updated Terms take effect.
25. Miscellaneous
These Terms and the policies incorporated into them constitute the entire agreement between you and Tropein regarding their subject matter, except for any separate written agreement signed by Tropein.
If a provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective, subject to the special severability rules in Section 20.
Tropein’s failure to enforce a provision is not a waiver.
You may not assign or transfer your rights or obligations under these Terms without Tropein’s written consent. Tropein may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, asset sale, or by operation of law.
Headings are for convenience and do not affect interpretation.
